Introduction and Acceptance
These Terms of Service ("Terms") govern your use of the GoFathom application ("App", "Platform", "Service") and all related services provided by GoFathom Ltd ("we", "us", "our", "Company"). The App includes our mobile applications, website, and all related features and functionality.
By accessing or using the GoFathom App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
FOR USERS UNDER 18: If you are under 18 years of age, you may only use this Service with the involvement and consent of a parent or guardian, and you confirm that you have such consent.
Where you access the Service as, or on behalf of, an organisation under a separate Master Subscription Agreement, that agreement will take precedence over these Terms to the extent of any conflict.
2. Description of Service
GoFathom is a specialised sports coaching platform that facilitates communication between coaches, parents, and young athletes. Our Service includes:
• Feedback Management — coaches can provide structured feedback to players and families
• Training Session Tracking — monitoring training loads, workloads, and rest requirements
• Educational Resources — access to training drills, courses, and development materials
• AI-Powered Reports — automated compilation of feedback into personalised reports
• Family Dashboard — a centralised view of multiple children's athletic development
• Multi-Group Management — organisation and club-level management tools
3. User Categories and Eligibility
3.1 User Types
The Platform serves three primary user categories:
• Coaches — verified sports coaches and instructors
• Parents — parents and guardians of young athletes
• Players — young athletes (primarily Under-19)
3.2 Registration Requirements
• Institution-driven onboarding — registration is managed by authorised sports organisations (clubs, schools, sports academies); parents cannot self-register
• Players must be under 19 years of age at registration
• All coaches must be verified by their respective organisations
• All player registrations require explicit parental consent
3.3 Account Responsibility
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information during registration
• You must notify us immediately of any unauthorised use of your account
4. User Conduct and Acceptable Use
4.1 General Conduct
You agree to use the Service only for its intended purpose of athletic development and coaching communication. You will not:
• Use the Service for any unlawful purpose or in violation of any law
• Harass, intimidate, threaten, or harm other users
• Impersonate any person or entity or misrepresent your affiliation
• Upload or share inappropriate, offensive, or harmful content
• Attempt to gain unauthorised access to other users' accounts or data
4.2 Child Safety and Protection
Given our focus on youth sports, we maintain strict standards regarding child safety:
• All interactions must be appropriate and professional
• Private messaging between coaches and players is prohibited within the App, as all feedback is visible to parents
• Any suspected inappropriate behaviour must be reported immediately
• Content shared must be suitable for all ages
• Bullying, harassment, or inappropriate language will result in immediate account termination
4.3 Sports-Specific Guidelines
• Feedback must be constructive and development-focused
• Training session data must be accurate to ensure player safety
• Coaches must follow sport-specific safety guidelines and protocols
• Users must respect the private nature of feedback and not share it without permission
4.4 Conduct Toward Coaches and Organisations
You will not direct abusive, threatening, harassing, defamatory or intimidating conduct toward any coach, organisation, member of staff or other user, whether through Platform content, messages, or otherwise. Coaching feedback is provided to support player development; disagreement with a coaching opinion, assessment or selection decision does not entitle any user to engage in such conduct. We may suspend or terminate the account of any user who breaches this provision, and may report unlawful conduct to the relevant organisation or authorities.
5. Privacy and Data Protection
5.1 Privacy Policy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
5.2 Data Protection Compliance
We are committed to compliance with the UK GDPR and the Data Protection Act 2018. Parents have control over:
• Whether feedback can be shared across organisations
• Data retention preferences
• Access to all data collected about their children
• The right to data portability and deletion
5.3 Child Data Protection
Special protections apply to data from users under 18:

• Enhanced security measures

6. Content and Intellectual Property
6.1 User-Generated Content
You retain ownership of content you create, but you grant us a licence to use, display, and distribute such content within the Platform for its intended purpose.

All Platform-provided content, including educational materials, courses, and AI-generated reports, remains our intellectual property. You may use this content solely within the Platform for its intended purpose.

6.4 Responsibility for User Content
Users are solely responsible for the content they submit, including feedback, comments and messages. GoFathom acts as a host of user-generated content and does not author, monitor, verify or endorse it. If you believe content on the Platform is defamatory, abusive or otherwise unlawful, you may notify us at team@gofathom.app and we will review it and, where appropriate, remove it. We rely on the protections available to operators of websites under applicable law, including section 5 of the Defamation Act 2013.
7. AI Features and Automated Processing
7.1 AI-Powered Reports
Our AI system compiles coaching feedback into personalised reports. By using this feature, you understand that:
• Reports are generated using automated processing
• AI analysis is based on coaching input and predefined criteria
• Reports are tools to assist development and should not replace professional coaching judgement
7.2 Data Usage for AI
Aggregated, anonymised data may be used to improve our AI algorithms, subject to privacy requirements and user consent.
8. Payment Terms and Pricing
8.1 Payment Terms
• If fees are charged, they are billed annually in advance
• All fees are non-refundable except as required by law
• We reserve the right to modify pricing with 30 days' notice
9. Platform Availability and Modifications
9.1 Service Availability
We strive to maintain high availability but cannot guarantee uninterrupted service. We may temporarily suspend the Service for maintenance or updates.

10. Termination
10.1 Termination by Users
You may terminate your account at any time by contacting your organisation administrator or our support team.
10.2 Termination by Us
We may terminate or suspend accounts for:
• Violation of these Terms
• Inappropriate behaviour, especially regarding child safety
• Non-payment of fees (for paid accounts)
• Inactivity for extended periods
10.3 Effect of Termination
Upon termination:
• Your access to the Service will cease
• Your data will be handled according to our Privacy Policy
• Certain provisions of these Terms will survive termination
11. Nature of Coaching Feedback and Opinions
11.1 Feedback, assessments, selections, ratings and development recommendations provided through the Platform represent the honest professional opinions and subjective judgement of the individual coach or organisation providing them. They do not constitute statements of fact.
11.2 GoFathom is a communication platform. We are not the author of, and do not endorse, verify or take responsibility for, any coaching feedback, opinion or decision made by a coach or organisation.
11.3 We make no representation, warranty or guarantee that any player will improve, achieve any particular standard, be selected for any team, squad or pathway, or attain any specific outcome. Athletic development depends on many factors outside the control of GoFathom or any coach.
11.4 Coaches and organisations are responsible for ensuring their feedback is given in good faith, is development-focused, and complies with their own safeguarding and coaching obligations.
12. Disclaimers and Limitation of Liability
12.1 Service Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, except as required by law.
12.2 Sports and Athletic Disclaimer
• The Platform is a communication tool and does not replace professional coaching or medical advice
• Users participate in sports activities at their own risk
• We are not responsible for injuries or incidents occurring during sports activities
• Training workload tracking is a tool to assist coaches but does not guarantee injury prevention
12.3 Limitation of Liability
(a) Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited, including your statutory rights as a consumer.
(b) Subject to clause 12.3(a), we shall not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profit, goodwill, opportunity, data or anticipated savings.
(c) Subject to clause 12.3(a), our total aggregate liability arising out of or in connection with these Terms or your use of the Service shall not exceed the greater of (i) the total fees paid by you or on your behalf in the twelve months preceding the event giving rise to the claim, or (ii) one hundred pounds (£100).
(d) We are not liable for the acts, opinions, decisions or content of any coach, organisation, parent or other user.
13. Indemnification
13.1 If you are using the Service as, or on behalf of, an organisation, coach, business or other non-consumer, you agree to indemnify and hold harmless GoFathom Ltd against any claims, losses, liabilities, damages and reasonable costs (including reasonable legal fees) arising from:
(a) your breach of these Terms
(b) content you submit to the Platform
(c) your infringement of any third party's rights
(d) your unlawful use of the Service
This indemnity does not apply to the extent a claim arises from our own negligence or breach.
13.2 Nothing in this clause requires a consumer to indemnify us beyond what is fair and enforceable under applicable consumer protection law, including the Consumer Rights Act 2015.
14. Force Majeure
14.1 We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including acts of God, failure of utilities or telecommunications, internet or hosting provider outages, failure of third-party services or APIs, cyber-attacks, epidemics or pandemics, government action, strikes, fire or flood.
14.2 If such an event continues for more than sixty (60) days, either party may terminate the affected services on written notice.
15. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales.

Disputes will be resolved through:

Nothing in this clause affects a consumer's right to bring proceedings in their local courts where applicable law so provides.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
16.2 Assignment
We may assign these Terms to any successor entity. You may not assign your rights without our written consent.
16.3 Entire Agreement
These Terms, together with our Privacy Policy (and, for organisations, any Master Subscription Agreement), constitute the entire agreement between us.

We reserve the right to update these Terms. We will notify users of material changes through the Platform or by email. Continued use after changes constitutes acceptance.

6.3 Third-Party Content
We may include links to external resources (training videos, sports courses). We are not responsible for third-party content or services.
6.4 Responsibility for User Content
Users are solely responsible for the content they submit, including feedback, comments and messages. GoFathom acts as a host of user-generated content and does not author, monitor, verify or endorse it. If you believe content on the Platform is defamatory, abusive or otherwise unlawful, you may notify us at team@gofathom.app and we will review it and, where appropriate, remove it. We rely on the protections available to operators of websites under applicable law, including section 5 of the Defamation Act 2013.
7. AI Features and Automated Processing
7.1 AI-Powered Reports
Our AI system compiles coaching feedback into personalised reports. By using this feature, you understand that:
• Reports are generated using automated processing
• AI analysis is based on coaching input and predefined criteria
• Reports are tools to assist development and should not replace professional coaching judgement
7.2 Data Usage for AI
Aggregated, anonymised data may be used to improve our AI algorithms, subject to privacy requirements and user consent.
8. Payment Terms and Pricing
8.1 Payment Terms
• If fees are charged, they are billed annually in advance
• All fees are non-refundable except as required by law
• We reserve the right to modify pricing with 30 days' notice
9. Platform Availability and Modifications
9.1 Service Availability
We strive to maintain high availability but cannot guarantee uninterrupted service. We may temporarily suspend the Service for maintenance or updates.

10. Termination
10.1 Termination by Users
You may terminate your account at any time by contacting your organisation administrator or our support team.
10.2 Termination by Us
We may terminate or suspend accounts for:
• Violation of these Terms
• Inappropriate behaviour, especially regarding child safety
• Non-payment of fees (for paid accounts)
• Inactivity for extended periods
10.3 Effect of Termination
Upon termination:
• Your access to the Service will cease
• Your data will be handled according to our Privacy Policy
• Certain provisions of these Terms will survive termination
11. Nature of Coaching Feedback and Opinions
11.1 Feedback, assessments, selections, ratings and development recommendations provided through the Platform represent the honest professional opinions and subjective judgement of the individual coach or organisation providing them. They do not constitute statements of fact.
11.2 GoFathom is a communication platform. We are not the author of, and do not endorse, verify or take responsibility for, any coaching feedback, opinion or decision made by a coach or organisation.
11.3 We make no representation, warranty or guarantee that any player will improve, achieve any particular standard, be selected for any team, squad or pathway, or attain any specific outcome. Athletic development depends on many factors outside the control of GoFathom or any coach.
11.4 Coaches and organisations are responsible for ensuring their feedback is given in good faith, is development-focused, and complies with their own safeguarding and coaching obligations.
12. Disclaimers and Limitation of Liability
12.1 Service Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, except as required by law.
12.2 Sports and Athletic Disclaimer
• The Platform is a communication tool and does not replace professional coaching or medical advice
• Users participate in sports activities at their own risk
• We are not responsible for injuries or incidents occurring during sports activities
• Training workload tracking is a tool to assist coaches but does not guarantee injury prevention
12.3 Limitation of Liability
(a) Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited, including your statutory rights as a consumer.
(b) Subject to clause 12.3(a), we shall not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profit, goodwill, opportunity, data or anticipated savings.
(c) Subject to clause 12.3(a), our total aggregate liability arising out of or in connection with these Terms or your use of the Service shall not exceed the greater of (i) the total fees paid by you or on your behalf in the twelve months preceding the event giving rise to the claim, or (ii) one hundred pounds (£100).
(d) We are not liable for the acts, opinions, decisions or content of any coach, organisation, parent or other user.
13. Indemnification
13.1 If you are using the Service as, or on behalf of, an organisation, coach, business or other non-consumer, you agree to indemnify and hold harmless GoFathom Ltd against any claims, losses, liabilities, damages and reasonable costs (including reasonable legal fees) arising from:
(a) your breach of these Terms
(b) content you submit to the Platform
(c) your infringement of any third party's rights
(d) your unlawful use of the Service
This indemnity does not apply to the extent a claim arises from our own negligence or breach.
13.2 Nothing in this clause requires a consumer to indemnify us beyond what is fair and enforceable under applicable consumer protection law, including the Consumer Rights Act 2015.
14. Force Majeure
14.1 We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including acts of God, failure of utilities or telecommunications, internet or hosting provider outages, failure of third-party services or APIs, cyber-attacks, epidemics or pandemics, government action, strikes, fire or flood.
14.2 If such an event continues for more than sixty (60) days, either party may terminate the affected services on written notice.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of England and Wales.
15.2 Dispute Resolution
Disputes will be resolved through:
• Good faith negotiation
• Mediation, if negotiation fails
• The courts of England and Wales, as a last resort
Nothing in this clause affects a consumer's right to bring proceedings in their local courts where applicable law so provides.
16. Miscellaneous
16.1 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
16.2 Assignment
We may assign these Terms to any successor entity. You may not assign your rights without our written consent.
16.3 Entire Agreement
These Terms, together with our Privacy Policy (and, for organisations, any Master Subscription Agreement), constitute the entire agreement between us.
16.4 Updates to Terms
We reserve the right to update these Terms. We will notify users of material changes through the Platform or by email. Continued use after changes constitutes acceptance.
